Inheritance theft is
called “Inheritance Hijacking” by Attorney Adamski because an
asset is diverted from its intended recipient to an unintended
recipient. This is similar to a truck being hijacked on a
highway.
The hijacked asset may
be one element of an estate, such as a bank account, or an
entire estate. For example, a son may convince his aged parent
to make the son a joint owner on a bank account, promising to
divide the account among his siblings at the parent’s death.
However, at the parent’s death the son refused to honor his
promise. The son has successfully hijacked his sibling’s share
of the account. This is an example of hijacking one asset. Had
the son done the same thing with the parent’s will the entire
estate would have been hijacked.
There is one thread
running through all hijackings: The hijacking is always a
surprise to the victim. A typical reaction to a hijacking is
something like, “How could my sister have done this to me? I
would have never suspected her of stealing from me.” Hijackings
are surprises because the victim does not have enough knowledge
to understand how they might be victimized. Your best defense
against the hijacking of your inheritance is knowledge.
